These Terms of Use ("Terms") are an agreement between you and Rosy Star AI Limited ("we," "us," or "our") governing your use of Crash Domino (the "Game," Android package `com.rosystar.gm.crashdomino`).
By downloading, installing, accessing, or using the Game, you agree to these Terms. If you do not agree, please do not use the Game.
You must be at least 13 years old to use the Game. If you are under the age of legal majority where you live, you may use the Game only with the consent and supervision of a parent or legal guardian. A parent or guardian who permits a minor to use the Game is responsible for the minor's use and purchases.
Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable license to install and use the Game on a compatible device that you own or lawfully control, solely for personal, non-commercial entertainment.
The Game and all associated software, artwork, audio, levels, text, trademarks, and other materials are licensed, not sold. We and our licensors retain all rights not expressly granted to you.
The Game may require an internet connection for ads, purchases, content downloads, purchase validation, analytics, crash reporting, and other online features. Your network provider may charge data fees.
Game progress and settings are primarily stored locally. Unless the Game expressly provides cloud saving, clearing app data, uninstalling the Game, resetting your device, or changing devices may permanently erase your progress.
The Game may offer coins, energy, boosters, ad-removal rights, and other digital content ("Virtual Items"). Virtual Items are licensed only for use within the Game. They have no cash value, are not real-world property or currency, and may not be sold, transferred, or redeemed for money unless applicable law requires otherwise.
Android purchases are processed by Google Play. Prices, taxes, payment methods, and final charges are shown on the Google Play purchase screen. Refunds are governed by applicable law and Google Play's refund policies.
We may remove or adjust Virtual Items associated with a refund, chargeback, revocation, fraud, error, or duplicate delivery. Consumable items that have been delivered and used may not be restorable. The Game currently offers one-time purchases and does not offer automatically renewing subscriptions unless a future purchase screen clearly states otherwise.
If a purchase is not delivered, use Restore Purchases where available and contact us with your Google Play order number. Do not send us your password or full payment-card number.
The Game may display banner, interstitial, and rewarded advertisements through Unity LevelPlay (ironSource), Unity Ads, or other advertising providers. A rewarded-ad benefit may require confirmation that the advertisement was completed. Advertisements and linked third-party services are governed by their own terms and privacy policies.
Google Play, Firebase, Unity, advertisers, and other third-party providers operate independently. We are not responsible for their availability, content, products, or services, except to the extent responsibility cannot be excluded by law.
You may not:
- use the Game for illegal, fraudulent, harmful, harassing, or infringing activity;
- cheat or use bots, scripts, auto-clickers, mods, trainers, or other unauthorized tools;
- exploit bugs, duplicate rewards, falsify purchases, or create invalid advertising traffic;
- interfere with or disrupt the Game, servers, networks, security features, or another user's device;
- copy, distribute, sell, rent, modify, or commercially exploit the Game or Virtual Items without permission;
- impersonate another person or misrepresent an affiliation with us; or
- reverse engineer, decompile, disassemble, or attempt to obtain the Game's source code, except where applicable law expressly permits it.
We may investigate suspected violations and take reasonable action, including reversing improper rewards, restricting online features, suspending access, or terminating your license.
The Game and its content are protected by copyright, trademark, and other intellectual-property laws. You may not use the name "Crash Domino" in a way that suggests authorization, sponsorship, or endorsement without our written permission.
If you voluntarily send suggestions, ideas, or feedback, you grant us a worldwide, perpetual, non-exclusive, royalty-free license to use and incorporate that feedback to develop or improve our products without compensation to you.
We may provide updates, new content, balance changes, bug fixes, or security patches. Some updates may be required to continue using the Game. We may change, suspend, or discontinue all or part of the Game for technical, security, legal, platform, or business reasons.
You may stop using and uninstall the Game at any time. We may suspend or terminate your access if you materially violate these Terms, commit fraud, attack the Game, infringe third-party rights, or if required by law or a platform provider.
To the fullest extent permitted by law, the Game is provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Game will always be available, uninterrupted, error-free, secure, or compatible with every device.
Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted by law. Nothing in these Terms excludes any warranty or consumer right that cannot legally be excluded.
To the fullest extent permitted by law, we and our affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, or data arising from the Game.
Our total liability arising from the Game or these Terms will not exceed the greater of the amount you paid for the Game during the 12 months before the event giving rise to the claim or US$50.
These limitations do not apply to fraud, willful misconduct, gross negligence, personal injury, or any liability or consumer remedy that cannot legally be limited.
Our Crash Domino Privacy Policy explains how we collect, use, and share information and describes your privacy choices. It forms part of these Terms for notice purposes.
These Terms are governed by applicable U.S. federal law and, where state law applies, the non-waivable laws of the state in which you reside, without regard to conflict-of-laws principles.
Before filing a claim, please contact us and provide a description of the dispute and your requested resolution. We will attempt to resolve the matter informally. If it cannot be resolved, either party may bring a claim in a state or federal court of competent jurisdiction, subject to any non-waivable consumer rights concerning governing law and venue.
These Terms do not require arbitration or waive any right that cannot legally be waived.
We may update these Terms because of changes to the Game, our operations, platform requirements, or law. We will update the date above and provide additional notice when required. If you do not agree to updated Terms, you must stop using the Game.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our permission. We may transfer these Terms as part of a merger, acquisition, reorganization, financing, or sale of our business, subject to applicable law.
These Terms, the Privacy Policy, and the terms displayed on the applicable Google Play purchase screen form the entire agreement concerning your use of the Game.
